Mobile Text Messaging Program Terms & Conditions

Mobile messaging is used to communicate appointment reminders, order alerts, occasional marketing and account notifications, as well as for ongoing patient communication to follow-up on treatment results and assist with any needed pre- or post-treatment guidance.

1. Opt-In Process

To receive text messages from Less Is More Medical, you must opt-in to our mobile messaging program. There are two methods to provide consent for this service.

Patient-initiated consent: You can opt-in by texting “JOIN” to 619-289-8488.
Electronic medical record (EMR) form consent: You may also provide your consent via the EMR form, either remotely via the booking portal or in-person at one of our locations.

By opting in, you consent to receive messages from us at the phone number you provided. Messages may be clinical, marketing, or informational, and may be individual or automated communications. Standard messaging and data rates may apply depending on your mobile carrier and plan. Less Is More Medical (DBA: Barbershop Brotox) is not responsible for any charges incurred from your mobile carrier.

2. Confirmation Message

Upon opting in, you will receive a confirmation message that includes the following:

Brand Name: Less Is More Medical

Message Frequency Disclosure: "You may receive up to 10 messages per month."
Fee Disclosure: "Message and data rates may apply."
Opt-Out Instructions: "Reply STOP to cancel."
Help Instructions: "Reply HELP for help or contact us at info@lessismoremed.com or 619-289-8488."
Security Disclosure: "Despite security measures there is a risk of unauthorized disclosure of information when using mobile messaging.”

Example Confirmation Message: "Welcome to Less Is More Medical! You may receive up to 10 msgs/month. Msg & data rates may apply. Reply HELP for help, STOP to cancel. Contact info@lessismoremed.com or 619-289-8488. Despite security measures there is a risk of unauthorized disclosure of information when using mobile messaging."

3. Opt-Out Instructions

You can opt-out of our mobile messaging program at any time by replying "STOP" to any of our messages. Upon opting out, you will receive a confirmation message:

Example: "You have successfully unsubscribed from Less Is More Medical. No further messages will be sent. For assistance, contact info@lessismoremed.com or 619-289-8488."

4. Help Instructions

If you need assistance, reply "HELP" to any message, and you will receive the following response: " Less Is More Medical: For help, information can be found at www.lessismoremed.com. You may also contact info@lessismoremed.com, or call 619-289-8488 for support."

5. Message Frequency

The number of messages you will receive depends on your subscription preferences. Unless otherwise specified, you can expect to receive up to 10 messages per month.

6. Message and Data Rates Disclosure

Standard message and data rates may apply to all mobile messages sent or received as part of our messaging program. Please consult your mobile carrier for more information about your messaging and data plan.

7. Compliance

Protected health information (PHI) will only be communicated via mobile text messaging when a patient has initiated contact or requested provider-patient communications by text message. In this circumstance, Less Is More Medical (DBA: Barbershop Brotox) will warn the patient that the risk of unauthorized disclosure exists and obtain the patient’s consent to communicate by text. Both the warning and the consent are documented in the patient’s profile.

Less is More Medical (DBA: Barbershop Brotox) is committed to maintaining the privacy, security and confidentiality of the protected health information (PHI) of our patients. Any personal information collected as part of our mobile messaging program, including your phone number, will be used and stored only in compliance with this Privacy Policy, the Health Insurance Portability and Accountability Act (HIPAA), and the California Consumer Privacy Act (CCPA).

1. Types of Information we Collect

We may collect the following information about you:

Your name, address, email address, phone number(s), date of birth, address, and other non-medical demographic information.
Reward program enrollment information such as Aspire, Evolus, and Allē.
We use this information to provide you with access to services; for example, to confirm your identity, contact you, inform you of new features and products, and invoice you. We also use this information to make sure that we comply with the legal requirements.
Questions, feedback, and other messages you address to us directly through tech support, online forms, and social media platforms.
Photos are obtained for clinical and marketing purposes only if appropriate written consent is expressly obtained and on record.
Relevant clinical information pertinent to the provision of services, such as past medical and surgical history, social history, family history, examination findings, laboratory results and other diagnostic data.

2. How we Use Your Information

We may use the information collected for purposes such as:

Continuity of services over multiple treatments.
Treatment photos, when appropriate consent is obtained and on record, may be used for educational and other promotional purposes.

3. Data Sharing

In the event Less Is More Medical (DBA: Barbershop Brotox), Inc. is involved in a merger, acquisition, transfer of control, bankruptcy, reorganization or sale of assets, or diligence associated with such matters, we may sell or transfer the information described in this Privacy Policy as part of that transaction. We otherwise do not share, sell, or rent data (including mobile information, text message originator opt-in data, and consent) with any third parties/affiliates. Patient information is securely stored in accordance with HIPAA regulations and only used for the purposes stated in this policy.

Employees are prohibited from accessing their own medical record information, as well as friends, co-workers, and family members unless done for the provision of business services.
